Terms of Service
Thank you for using Wisedox. These Terms of Service ("Terms") apply to your use of our website and service. Please read them carefully and let us know if you have any questions. By using Wisedox, you agree to be bound by these Terms. If you're using Wisedox on behalf of an organization, you agree to these Terms on behalf of that organization.
Service Operator
Company Wisedox s.r.o. (Karlovo náměstí 290/16, Prague 2, ID 02048124, Vat ID CZ02048124, File C 214228 registered at the Municipal Court in Prague)
(hereinafter referred to as the “Operator”), is, among other things, the operator of a Website and a Service, where:
(a) “Website” means internet servers accessible at the URLs https://wisedox.io, including all web pages on derivative domains as well as any other websites operated by the Operator; and
(b) "Service" means Software as a Service (SaaS) provided by the Operator accessible at the URL https://[yourcompany].wisedox.io
Service Definition
Wisedox, operated by Wisedox s.r.o., provides documentation software as a service. The service is intended to facilitate creation and management of automated and secure infrastructure documentation.
Service Abuse
The service is intended to be used by civilized people. If we notice abuse, like excessive requests, excessive data transfer or account sharing, you will be given a warning, after which your account may be terminated if the behavior is not corrected.
Refund Policy
If you are not happy with our service, you can apply for a refund within 30 days
Payment policy
When paying via credit card (GoPay):
The Wisedox subscription paid via credit card (GoPay) is set for one year, and recurring payments are always activated upon its initiation.
If the payment fails, we will attempt to process it again up to three more times, each 24 hours after previous attempt.
If the payment is successfully processed, you can continue using Wisedox uninterrupted. The start of the new subscription period automatically follows the end of the previous one.
If the payment is not successful after 3 attempts, you will no longer be possible to make changes to your data in Wisedox. Once the payment is successful, access to Wisedox will be restored, and a new subscription period with automatic renewal will be activated.
Wisedox subscriptions are always paid for the whole subscription period (month or a year) in advance, and no debt is incurred if a payment fails.
Recurring Payments
With your consent, which you grant by checking the appropriate box for agreeing to recurring payments directly in the order form, Wisedox uses a recurring payment system (i.e., automatic deductions from a payment card, known as recurring payments) for the sale of the Service, for the duration of the subscription.
To process recurring payments, Wisedox uses the GoPay payment gateway operated by GoPay s.r.o.
By checking the consent box, you agree to the establishment and parameters of the recurring payment (details are provided below) and to the storage of payment details by the GoPay payment gateway.
Recurring Payment Parameters for the Service:
a. The payment covers a selected subscription (i.e., one calendar year or 30 days starting from the date of the first recurring payment).b. The payment will be deducted on the first day of each subscription period for as long as the Service is used.
c. A fixed amount based on the price of the selected service package will be deducted for each individual payment.
d. If the price of the selected Service package changes, you will be notified in advance via email and can decide whether to continue using the Service or cancel it.
e. Users can disable the renewal of the Service at any time in their Wisedox app.
Taxation
Based on your location and billing address, the VAT applicable in your country will be added for individual customers and businesses without a valid VAT number. We will forward all VAT payments to the responsible tax authorities on a quarterly basis.
Free (trial) Accounts
You can use your account even without an active subscription as a free trial account, which is subject to lower limits than paid plans.
Limitation of Liability
Wisedox is designed as a documentation solution. We use different measures to protect your data from hardware failure as well as there is an additional geographic redundancy, i.e. your data is backed up on a physically separated location. To the fullest extent allowed by law, Wisedox (and Wisedox s.r.o.) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (A) your access to, use of, inability to access, or inability to use our service; (B) any unauthorized access, use, or alteration of your content.
Linked Products and Services
Sites that we link to may contain links to websites, services, and advertisements that we neither own nor control. We don't endorse or assume responsibility for any third-party sites, information, materials, products, or services.
Entire Agreement
These Terms and our Privacy Policy constitute the entire agreement between you and Wisedox. If any provision of these Terms is found to be unenforceable, the remaining provisions of these Terms will remain in full force and effect.
Modification
The Terms may be modified from time to time. We will notify you about any changes. You'll agree to accept any changes or revisions to the Terms by continuing to use our service.
Governing Law
These Terms shall be governed by the laws of the Czech Republic, without regard to its conflict of law provisions.
All disputes that may arise in the course of or in connection with the provision of our services shall be finally settled, excluding the jurisdiction of the ordinary courts, by arbitration before the Arbitration Court of the Czech Chamber of Commerce and the Agrarian Chamber of the Czech Republic in Prague in accordance with its Rules online by a single arbitrator appointed by the President of the Arbitration Court of the Czech Chamber of Commerce and the Agrarian Chamber of the Czech Republic.
